Liability and Usage Agreement

1. Assumption of Risk

I understand that using the Dynamic Arts Makerspace facility, including its workshop equipment, tools, materials, and participation in classes, workshops, and events, involves inherent risks. These risks include but are not limited to cuts, burns, eye injuries, respiratory hazards, electric shock, hearing damage, exposure to dust and fumes, and other physical harm. I voluntarily assume all such risks associated with my use of the facility and participation in activities.

2. Release of Liability

I hereby release, discharge, and hold harmless Dynamic Arts LLC, its owners, officers, employees, instructors, volunteers, agents, and representatives from any and all claims, demands, damages, costs, expenses, and causes of action arising from or related to my use of the facility, equipment, or participation in any classes, workshops, or events, including those caused by the negligence of Dynamic Arts LLC or any of the released parties.

3. Safety Requirements

I agree to:

• Wear appropriate personal protective equipment (PPE) including safety glasses, hearing protection, dust masks, and other equipment as required for each activity
• Follow all posted safety rules, signage, and instructor directions at all times
• Complete required equipment certification classes before using any equipment independently
• Report all equipment malfunctions, injuries, near-misses, and safety hazards to staff immediately
• Never operate any equipment while impaired by drugs, alcohol, fatigue, or any condition that affects my judgment or physical ability
• Not remove or disable any safety guards, switches, or protective devices
• Keep my work area clean and organized during and after use

4. Equipment Use

All workshop equipment is used at my own risk. I will not operate any equipment for which I have not received proper training or certification from Dynamic Arts staff. I accept full responsibility for any damage to equipment, materials, or the facility caused by my negligence, carelessness, or misuse. I agree to pay for repairs or replacement of any equipment I damage through improper use.

5. Medical Authorization

In the event of an injury or medical emergency, I authorize Dynamic Arts staff to obtain emergency medical treatment on my behalf. I understand that I am responsible for all medical costs incurred. I will inform staff of any relevant medical conditions, allergies, or medications before participating in activities.

6. Photo and Video Consent

I consent to being photographed, filmed, or recorded while at Dynamic Arts Makerspace. Images and recordings may be used for marketing, social media, website content, and promotional materials. I may opt out of this consent at any time by notifying staff in writing.

7. Code of Conduct

I agree to:

• Treat all members, staff, instructors, and guests with respect and courtesy
• Refrain from any form of harassment, discrimination, or intimidation
• Follow staff directions regarding facility use, scheduling, and safety
• Not bring unauthorized guests into the workshop without staff approval
• Maintain a safe and professional atmosphere at all times

Violation of the code of conduct may result in immediate removal from the facility and termination of membership or class enrollment without refund.

8. Indemnification

I agree to indemnify and hold harmless Dynamic Arts LLC from any claims, damages, or expenses (including attorney fees) arising from my actions or omissions while using the facility, or from any breach of this agreement.

9. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of Maryland. Any disputes arising under this agreement shall be resolved in the courts of Baltimore City.

10. Acknowledgment

By creating an account at Dynamic Arts Makerspace, I acknowledge that I have read, understand, and voluntarily agree to all terms of this Liability and Usage Agreement. I understand that this agreement is binding and affects my legal rights.
